The North Colonie Central Schools may lease space to other schools or programs provided that the property is not needed for school district purposes and that the leasing of such property is in the best interest of the school district. The terms of any lease of property by the school district will include:
(1) The rental payment must not be less than fair market value as determined by the Board of Education.
(2) The term of the lease will not exceed ten years, or five years if the lease is to another union free or central school district, without approval through a voter referendum.
(3) Upon termination of the lease, the lessee is obligated to restore the property to its original condition, unless the school district has waived the requirement.
Any such lease may not be made to the benefit of any public or school officer. All such leases will comply with I.R.S. regulations related to the use of school district financed facilities. Priority for use of space will be given to programs which are beneficial to students or other residents of the district. Only schools or programs which are certified by the State to receive public school students will be able to make fiscal arrangements for ancillary services in addition to those services related to leasing physical space.
