6251-R, Leasing School District Property Regulation

  1. The Board of Education will decide on the availability of facilities for leasing. The facilities are only available if the property is not currently needed for school district purposes and the leasing of such property is in the best interest of the school district.
  2. Any lease of school district property to any other union free or central school district is subject to the approval of the commissioner prior to becoming effective.
  3. If the district agrees to lease space to an out-of-district school, the district shall include charges in the leasing arrangement for utilities and custodial services. The out-of-district school or program will be able to use the library, playground, gymnasium or cafeteria as long as such use does not interfere with use by district students and staff. All arrangements for shared use of the facility should be made through the Principal and/or the chief business official.
  4. The out-of-district school or the program leasing the facility must assume full responsibility for supervision of its own students.
  5. Only schools or programs which are certified by the State to receive public school students may make fiscal arrangements for ancillary North Colonie services. If a program which is certified by the State is leasing space in a North Colonie school and wishes to use North Colonie medical or faculty services, the district will decide whether to agree to such an arrangement based upon the availability of resources. If North Colonie agrees to offer ancillary medical or faculty services, the school/program will reimburse the district for the cost of such services.
  6. All leases will be in compliance with I.R.S. regulations related to the use of school district financed facilities.
